“Segons el dictamen de l'Agència Catalana de Protecció de Dades sobre la publicació de les actes de la Junta de Govern Local a la web municipal, les sessions d’aquest òrgan no tenen caràcter públic, d'acord amb el que estableixen els articles 70.1 de la Llei 7/1985, de 2 d'abril, reguladora de les bases del règim local, i 156.1 del Text refós de la Llei municipal i de règim local de Catalunya, aprovat pel Decret legislatiu 2/2003, de 28 d'abril.

En el mateix sentit, l'article 113.1 b) del Reglament d'organització, funcionament i règim jurídic de les entitats locals, aprovat pel Reial decret 2568/1986, de 28 de novembre, també estableix que les sessions de la Junta de Govern Local no són públiques, sens perjudici de la publicitat dels acords i la tramesa a la comunitat autònoma i l'Administració de l'Estat, i de la tramesa d'una còpia de l'acta a tots els membres de la corporació.

Per tant, i amb independència que continguin o no dades de caràcter personal, només podran tenir accés a les actes de la Junta de Govern Local aquelles persones que estiguin legitimades d'acord amb la legislació aplicable. Amb aquesta finalitat, caldrà tenir present el règim d'accés de l'article 37 de la Llei 30/1992, de 26 de novembre, de règim jurídic de les administracions públiques i del procediment administratiu comú.

Per tot això exposat, l’Ajuntament de Sant Joan de les Abadesses, a fi de complir amb la normativa actual, ha procedit a retirar de la web municipal les actes de la Junta de Govern Local que fins ara es publicaven amb l’única voluntat d'oferir als ciutadans el dret d'accés a la informació en poder de l'administració pública i la transparència en el desenvolupament de les seves funcions “.

En aquest document informem als diferents proveïdors de l'Ajuntament què és una factura electrònica i com poden emetre-la i presentar-la a aquesta Corporació.

Què és una factura electrònica?

És un document electrònic que conté la mateixa informació que hi ha en una factura tradicional i que es transmet a través de mitjans electrònics. Aquest document ha d'estar signat electrònicament amb un certificat digital reconegut, cosa que garanteix la seva autenticitat, integritat i li ofereix la mateixa validesa legal que una factura en paper.

Quins avantatges té la factura electrònica?

A banda de tots els efectes beneficiosos que representa pel medi ambient la reducció de l´ús del paper, la factura electrònica té, entre d´altres, els avantatges següents:

• Possibilitat de presentar factures 24 hores del dia, els 365 dies de l'any.
• Estalvi de costos de generació, enviament i emmagatzematge de factures electròniques, enlloc d'emprar el suport paper.
• Plenes garanties en la recepció i registre de factures per part de l´Ajuntament.
• Reducció del temps de tramesa: pràcticament és immediat.
• Agilització dels terminis de pagament en permetre que la facturi entre abans al circuit de validació.
• Eliminació del rebuig de factures per errors en el seu contingut. La factura electrònica és validada en el moment d'introduir-la i, és rebutjada en el cas de contenir errors.
• Seguiment en temps real de l'estat de les factures.

Requisits previs

• Per a poder emetre una factura electrònica cal que el proveïdor disposi d'un certificat digital vàlid reconegut per l'Agència Catalana de Certificació, on coincideixi el CIF/NIF d'aquest certificat amb el de l'emissor de la factura. • En cas de ser una persona física, si no es disposa d'un certificat digital, poden fer ús del seu DNI digital per a signar les factures electròniques que emetin.
• Un altre requisit a l'hora de generar una factura electrònica és que el proveïdor ha de introduir obligatòriament la referència comptable que li haurà indicat el servei gestor de l'Ajuntament. Aquesta referència és la garantia de cara al proveïdor de l'existència de la consignació pressupostària corresponent pel seu pagament posterior. No serà admesa cap factura que no indiqui la referència comptable, les factures seran rebutjades automàticament.

Punt d'entrada de factures

L'Ajuntament de Sant Joan de les Abadesses ha habilitat a la seva seu electrònica l'enllaç a la bústia de lliurament de factures electròniques de l'ens. Aquest punt d'entrada és el portal e.FACT del consorci AOC. Des d'aquest portal un proveïdor podrà presentar factures i consultar l'estat de tramitació en el que es troben.
El format electrònic per a emetre factures electròniques a l'Administració és FACTURAE, segons l'Ordre PRE/2971/2007. El portal e.FACT admet aquest format però també accepta factures electròniques amb format INVOIC d'UN/EDIFACT transmeses a través de xarxes EDI amb connectivitat al servei.

Com es pot generar una factura electrònica?

Els proveïdors poden disposar de programari per a la seva gestió de factures que ja genera factures en el format Facturae, admès pel portal e.FACT. En cas que el proveïdor no disposi d'aquest programari podrà utilitzar altres eines gratuïtes que generin factures en aquest format:

• www.facturae.es: a través de l'aplicació gratuïta Gestió de facturació electrònica que ofereix el Ministeri d'Indústria, Turisme i Comerç (www.facturae.es).
• B2B Router (recomanat): servei al núvol que permet crear factures electròniques en format Facturae fàcilment, sense necessitat de certificat digital, de forma gratuïta i enviar-la directament a les Administracions Públiques catalanes a través del servei e.FACT ( www.b2brouter.net/ca).

Altres solucions:

• www.hazteunafacturae.com: aquesta web en la versió BASIC admet l'enviament gratuït de només 3 factures al mes.
• FacturaDirecta by Conductiva.
• Mitjançant una interfície de facturació electrònica en local per a Microsoft Word 2010 o Microsoft Excel 2010 i que es pot descarregar gratuïtament en el següent enllaç http://offinvoice.codeplex.com (o versió Microsoft Word 2007 a: http://factoffice.codeplex.com).

COM LLIURAR-LES A L'AJUNTAMENT?

Per enviar les factures electròniques a l'Ajuntament de Sant Joan de les Abadesses podeu utilitzar diferents mecanismes:

1. A través de la bústia de lliurament ubicada a la SEU ELECTRÒNICA de la web de l'Ajuntament:

2. A través de les plataformes de facturació electrònica que hi ha al mercat si aquestes es troben adherides al servei e.FACT.

Per a la utilització de la plataforma de les factures electròniques e.FACT, s'exigeix el codi DIR3 que en el cas de l'Ajuntament de Sant Joan de les Abadesses és el següent:

Aquest codi el podeu informar als tres camps de la efactura: oficina comptable, òrgan gestor i unitat tramitadora.

COM CONSULTAR L´ESTAT DE LA VOSTRA FACTURA?

Accedint a la bústia de lliurament de l'Ajuntament Sant Joan de les Abadesses, entrant a la pestanya "Consulta d'estats". Aquesta funcionalitat permet la recerca de factures enviades prèviament, de cara a consultar el seu estat de procés.

Per a consultar l'estat d'una factura heu d'informar dels següents camps: número de factura, any fiscal de la factura, NIF de l'emissor, NIF del receptor i l'import total de la factura. Una vegada completats aquests camps i prement sobre el botó "Cerca" es realitza la consulta, mostrant-se l'històric d'estats pels quals ha passat la factura especificada. D'aquesta manera, si la factura s'ha lliurat i registrat correctament a l'Ajuntament, es detalla, entre d'altres dades, la informació corresponent al registre d'entrada de la factura.

Destacar que en el cas que no visualitzeu l'estat "Registrada", això indica que la factura no s'ha registrat per l'Ajuntament. Així mateix, si la factura no supera la validació de la seva signatura electrònica o la factura no s'accepta per part de l'Ajuntament per motius comercials, la bústia de lliurament indicarà l'estat de "Rebutjada" i el motiu del rebuig.
Així mateix, és responsabilitat de l'emissor de les factures la consulta de l'estat de les mateixes.
